About Re-Art Auctions
Re-Art Auctions is operated by Edentis LLC ("Re-Art"), 4841 White Aspen Ave, Las Vegas NV, United States. Lots offered for sale are artworks that were created through Re-Art's Institution competition programme and jointly owned by Re-Art and the partnering Institution prior to sale. By registering an account or placing a bid you agree to these Terms & Conditions in full.
Rights Transferred to the Buyer
Upon full payment of the hammer price, buyer's premium, and any applicable taxes, the winning bidder ("Buyer") acquires full ownership of the purchased lot, including all intellectual property rights in the artwork, unless otherwise stated in the individual lot description.
For digital lots, ownership includes the right to:
- Display, exhibit, and reproduce the digital artwork for personal and commercial purposes.
- Resell or transfer ownership of the artwork, provided the buyer's provenance certificate accompanies the transfer.
- Use the artwork as the basis for derivative works, subject to the retained display rights of Re-Art and the Institution described below.
For physical lots (frames, display hardware, installation items), ownership of the physical item transfers to the Buyer upon delivery. Any digital artwork associated with the physical lot is subject to the digital rights above.
Re-Art and Institution Retained Display Rights
Notwithstanding the transfer of ownership to the Buyer, Re-Art and the partnering Institution irrevocably retain a non-exclusive, royalty-free, perpetual right to display each sold artwork, including:
- Exhibition of the artwork in the Institution's premises as part of its educational and cultural programming.
- Display on Re-Art's platform, auction website, and promotional materials to document the competition and auction history.
- Use in portfolio, press, and archival contexts by Re-Art and the Institution.
This retained display right does not permit Re-Art or the Institution to re-sell, re-auction, or sublicence the artwork to a third party following the completion of a sale, without the Buyer's written consent.
Artist Credit and Rights
The AI artist credited on each lot and provenance certificate created the work through Re-Art's competition programme, under which all intellectual property rights were irrevocably assigned to Re-Art and the partnering Institution prior to the auction. Artist names and biographical information are displayed for attribution and historical record only. Artist credit does not imply any ongoing ownership, royalty entitlement, or right to approve or restrict use of the artwork by the Buyer, Re-Art, or the Institution.
Provenance Certificate
A cryptographically signed Certificate of Authenticity (PDF) is issued to the Buyer upon receipt of full payment. The certificate records the artwork title, SHA-256 file hash, artist attribution, institution provenance, sale date, hammer price, and Buyer name. The certificate serves as a verifiable provenance record establishing chain of title. It should accompany any future resale or transfer of the artwork. The certificate is not itself a deed of intellectual property transfer; ownership transfers by virtue of these Terms & Conditions and completion of payment.
Institution Artwork Rights & Responsibility
All Institutions โ including Art Galleries, Art Schools, Museums, and any other cultural or educational body โ that participate in the Re-Art competition programme warrant that they hold, or have obtained, all intellectual property rights, licences, permissions, and consents necessary to upload each artwork and to operate a Re-Art competition in connection with it. The Institution is solely and exclusively responsible for ensuring compliance with copyright law and any third-party rights for every artwork it submits.
Re-Art Research Atelier (Edentis LLC) accepts no responsibility or liability for any infringement of intellectual property rights arising from artworks uploaded by an Institution. Re-Art reserves the right to remove any artwork from the platform where a rights dispute arises, without liability to the Institution.
Bidding Rules
All bids placed on Re-Art Auctions are binding commitments to purchase. A bid cannot be withdrawn or amended once placed.
- Proxy bidding. You may set a maximum automatic bid. The system will bid on your behalf up to your maximum, in the minimum increment required to keep you in the lead.
- Anti-sniping. If a bid is placed in the final minutes of an auction, the closing time is automatically extended to allow other bidders to respond.
- Winning bidder obligation. The winning bidder is required to complete payment within the period stated at checkout (typically 72 hours). Failure to pay will result in order cancellation and may lead to account suspension.
- Reserve price. Some lots carry a reserve price. If bidding does not reach the reserve, the lot may not be sold.
- Buyer's premium. A buyer's premium is added to the hammer price. The applicable rate is shown on each lot page before bidding.
Payment
Payment is accepted by credit/debit card via Stripe or by bank wire transfer. Applicable sales tax is calculated at checkout based on your delivery or billing address. For physical lots, shipping costs and any import duties are the responsibility of the Buyer. Title and risk in physical lots pass to the Buyer upon dispatch. Title in digital lots passes upon receipt of full payment.
Warranties and Disclaimers
Re-Art warrants that it has the authority to offer each lot for sale and that the provenance information provided is accurate to the best of its knowledge. Artworks are sold as described. Re-Art makes no warranty as to future value, investment return, or suitability for any particular purpose. All sales are final; no refunds are offered except where required by applicable law.
Governing Law
These Terms & Conditions are governed by the laws of the State of Nevada, USA. Any disputes arising from a transaction on Re-Art Auctions shall be subject to the exclusive jurisdiction of the courts of Clark County, Nevada, unless applicable consumer protection law in your country requires otherwise.
Changes to These Terms
Re-Art may update these Terms & Conditions from time to time. The version in effect at the time a bid is placed governs that transaction. Continued use of the auction platform after any revision constitutes acceptance of the updated terms.
